Our Party is not qualified to have Governorship Candidate in 2023 due to absence of NWC, ADC Members tell Court

Seeks court order to stop INEC from accepting ADC’s nomination due to Abuja court judgement.

Five members of the African Democratic Congress from Yagba East, Kabba/Bunu, Lokoja and Kogi Local Government Areas have approached a Federal High Court sitting in Lokoja to seek a restraining order to stop Independent National Electoral Committee from accepting any correspondence from the African Democratic Congress for the purpose of gubernatorial primary election coming up on the 15th of April in Kogi, Imo and Bayelsa, and a declaration that the party cannot validly produce a gubernatorial Candidate having not legally constituted a National Working Committee that is required by law to send notice of primary election to the Independent National Electoral Commission for the purpose of the governorship election in those states taking place on the 11th of November, 2023.

Other prayers sought in an originating summons number FHC/LKJ/CS/11/2023 and Motion for interlocutory injunction supported with a motion on notice filed on Tuesday by Ayodeji Victor, Emmanuel Oluwasegun Ikudagba and two others.

It will be recalled that a Federal High Court sitting in Abuja under Justice Muritala Nyako had in December 2022 sacked the Ralph Nwosu led National Working Committee of the African Democratic Congress. It will also be recalled that lawyers to the plaintiffs in the suite, led by Chief Mike Ozekhome SAN have applied for execution of the judgement for the properties of the party to be taken over in line with the judgement and same was effected recently.

Our findings reveals that based on the Justice Muritala Nyako Judgement, the African Democratic Congress ceased to have a validly nominated National Working Committee since August 2022 and cannot in the eyes of law participate in the coming gubernatorial election in Kogi, Imo and Bayelsa States.

Findings in the Federal High Court, Lokoja where the suite was instituted confirmed that the suite have been filed and awaiting date for hearing.
